We are pleased to announce that the new 5th edition of “Salinger on Factoring” is in the shops and online. The new edition has been written by Simon Mills, assisted by Noel Ruddy and Nigel Davidson of pdt solicitors. Professor Roy Goode has said the fact that the book is “a skilful blend of legal analysis and description of current practice governing domestic and international factoring, will ensure that this work maintains its pre-eminence as the standard work on this complex subject”.
Changes include new sections on the mechanics of transferring a client’s ledger and business between factors and the online trading of invoices, and extended treatment of the distinction between legal and equitable assignment, the priority rules as they affect factors, registration of charges under the Companies Act 2006 as notice, set-off and the debtor’s countervailing rights, the controversial topic of factor’s collection charges, the effect of insolvency upon the right to enforce debts, and the challenges concerning assignment and third parties and the Rome I Regulation.
