On 14th December 2017, Ian was instructed as junior counsel on behalf of the Appellant in HM Inspector of Health & Safety v Chevron North Sea Ltd. The appeal concerned the approach to be taken by an employment tribunal hearing an appeal against an enforcement notice under section 24 of the Heath and Safety at Work etc Act 1974. The Court is likely to decide whether the approach adopted by the Court of Session in the instant appeal is to be preferred to that approved by the Court of Appeal in Hague v Rotary Yorkshire Ltd.
Judgment was reserved and will be handed down in due course.
