Sam Phillips’ article discussing the decision of Nicklin, J in the case of LB Haringey v Simawi and Secretary of State (intervening) has been published in the latest issue of the Landlord and Tenant Review (L&T Review 2018, 22(3), 100-104).
The article considers the impact of the decision of the High Court to allow an Article 14 (Declaration of Incompatibility) Defence to proceed to trial after the underlying possession claim had been conceded and the matter had become ‘academic’.
Sam was counsel for the LB Haringey in the interim hearing and will appear for the Local Authority at the trial of the matter in October 2018.
