Sahana has been a member of Five Paper since April 2017. She is a member of both the Commercial and Property teams and is qualified to accept instructions on a public access basis.
Sahana accepts instructions in a range of commercial and property matters, with a particular focus on contractual disputes, personal and corporate insolvency, debt recovery and landlord and tenant disputes. She has a particular interest in commercial disputes with an international element, having both worked and studied in jurisdictions outside of England and Wales.
In 2018, Sahana was awarded a Pegasus Trust Scholarship to spend three months working in Dubai in the DIFC litigation department of a leading law firm and the registry of the DIFC Courts. During this time, Sahana gained significant experience of DIFC litigation involving the enforcement of court judgments and arbitral awards, as well as the resolution of conflicts of jurisdiction within the region, particularly between the DIFC and Dubai courts.
Prior to joining the Bar, Sahana worked as a stagière in Paris at White & Case in the firm’s International Arbitration department, assisting with drafting pleadings, legal research and translation in a multibillion-euro ICC construction arbitration.
Commercial and Insolvency
Sahana has a broad commercial and insolvency practice, appearing regularly in the County Court and Companies Court in relation to interim procedural applications, trials of contractual disputes, and on the presentation of winding-up petitions, acting for both petitioning creditors and companies. Sahana is also instructed to draft pleadings and applications notices, and has advised on matters such as the recovery of company assets from the police, the merits of a claim for breach of contract involving issues under the Limitation Act 1980 and the likely success of an application for a validation order.
While in Dubai, Sahana gained a thorough knowledge of the laws and procedural rules of the DIFC Courts. Sahana worked on the preparation of requests to produce and the review of document production in a complex insurance claim. She also prepared detailed research on matters of UAE law as applied in Dubai, such as the recoverability of consequential damages and the law on company ownership.
Sahana regularly appears for landlords and tenants in possession claims relating to mortgage arrears, rent arrears, anti-social behaviour, disrepair, succession and loss of security of tenure. She acts in claims for forfeiture and applications for relief in both the High Court and County Court and has appeared in the First Tier Tribunal (Property Chamber) in relation to service charge disputes. Sahana also has experience acting on public law and Equality Act 2010 challenges to possession proceedings and s.202 homelessness appeals in the County Court.
