Human rights, proportionality and the private landlord – Laura Williamson’s article is published in the Landlord and Tenant Review

In the October 2016 edition of the Landlord and Tenant Review, Laura comments on the Supreme Court ruling in the case of McDonald v McDonald, in which a private tenant sought to raise proportionality arguments under Article 8(2) of the ECHR in order to resist a claim for a possession order under s.21 of the Housing Act 1988. The article reviews the facts of the case, its progression through the courts and the ECtHR jurisprudence on the point, noting that the outcome of the case is entirely consistent with the aims of the Convention.
